The apex court, in its final judgment on the Adamawa gubernatorial legal battle, dismissed Binani’s petition for lacking evidence and substance

In a unanimous judgment delivered by Justice John Inyang Okoro, the Supreme Court declared that the Resident Electoral Commissioner (REC), who announced Binani as the winner of the governorship election, committed a serious act of criminality and irresponsibility.

Justice Okoro remarked that Binani deceived herself by clinging to the REC’s unlawful and unconstitutional acts to present herself as the winner of the governorship poll. The apex court strongly asserted that the REC lacked the authority, under any known law, to declare election results as witnessed in the Adamawa gubernatorial election

Justice Okoro emphasized that the sole person vested with the authority to make declarations in elections is the Returning Officer.

He cautioned public officers to consistently operate within the confines of the law in fulfilling their responsibilities and advised against succumbing to greed

Justice Okoro dismissed Binani’s petition and upheld the concurrent findings of the Adamawa State Election Petitions Tribunal and the Court of Appeal, which had earlier dismissed the petition by Binani and the APC.

Kanyi Daily recalls that the Independent National Electoral Commission (INEC) on Tuesday evening declared incumbent Governor, Ahmadu Fintiri as the winner of the Adamawa State Governorship Election.
