Johnson was shot dead on March 31 when some police operatives stormed Olu Aboderin Street, in the Onipetesi area of Lagos State.
The victim was watching a football match between Liverpool and Tottenham Hotspur when the incident happened.
Ogunyemi was charged with murder before the court on April 5, as his plea was not taken.
The Magistrate, A.O. Salawu, had ordered his remand in the Ikoyi prisons pending legal advice from the Directorate of Public Prosecutions.
At the Monday proceedings, the prosecuting counsel, Kehinde Olatunde, informed the court that the DPP’s advice was not ready.
Salawu thereafter adjourned the case till June 10 for advice from the DPP.
