A Magistrate Court sitting in Ondo town, headquarters of Ondo West Local Government area of Ondo State, has remanded two brothers of same parents in correctional facility for engaging each other in street fight.
It was gathered Gbenro Omokehinde, 27, and his elder brother, Segun Omokehinde, 30, during a scuffle used cutlass to attack each other.
The siblings, who were arraigned before Magistrate Odenusi Fadeyi, were charged on alleged breach of public peace.
According to the police prosecutor, Joseph Adula, the defendants committed the offence on October 13, 2019, at about 11:50 pm at kabiyesi camp via Ondo.
An offence he told the court is contrary to and punishable under section 249(d) of the Criminal Code Cap 38 Volume 1 Laws of Ondo State of Nigeria, 2006.
The charge read in part, ”That you, Omokehinde Gbenro and Omokehinde Segun on October 13, 2019, at about 11:50 pm at Kabiyesi camp via Ondo, in the Ondo Magisterial District did conduct yourself in a manner likely to cause the breach of peace by using cutlass to attack each other causing chaos situation at Kabiyesi camp.
“That you Omokehinde Gbenro and Omokehinde Segun on the same date, time and in the aforementioned magisterial district did engage each other in a public fight at Kabiyesi camp via Ondo and thereby committed an offence contrary to and punishable under section 83 of the Criminal code cap 37 volume 1 laws of Ondo State of Nigeria 2006.”
The defendants, however, pleaded not guilty to the charges.
The Prosecutor told the court that he would be calling three witnesses to testify in the case while the defence counsel, Mr. Israel Ikuemonisan, applied for the bail of the defendants in most liberal terms.
The presiding magistrate, Mrs. Odenusi Fadeyi, ordered the remand of the defendants in prison and adjourned the case till October 23, 2019, for bail consideration.
