The PDP and Atiku/Obi have once again applied to adopt the 6 different appeals.
But counsel to INEC and Buhari and APC argued against it and asked the Supreme Court not to admit the other appeals apart from the main appeal earlier filed by the PDP and Atiku/Obi.
Chief Olanipekun, counsel to President Buhari while arguing against the position of the PDP and Atiku/Obi cited some portions of the judgments of the Appeal Court, saying that the court below had taken cared of most of the appeals and grievances being canvassed by Dr. Livy Uzochukwu of the PDP and Atiku/Obi.
Counsel to the APC, Chief Fagbemi also informed the court that the APC has filed a cross appeal, challenging the decision of the court below and asking the Supreme Court to delete some paragraphs and evidence pw59 snd 60 as contained in the petition of the PDP and Atiku/Obi.
Chief Yunus of INEC adopted his replies to the PDP and Atiku/Obi’s appeals and argued that the Petitioners failed to prove that the 2nd respondent, Muhammadu Buhari of the APC did not win majority of lawful votes based on the number of witnesses called.
He also argued that the appellants could not prove the particular server they pleaded.
Chief Wole Olanipekun, while adopting his replies and cross appeals argued that the PDP and Atiku/Obi’s counsel, Dr. Livy Uzochukwu cannot probate and reprobate at the same times.
He was making reference to the issue of the names and judgment of the lower court on the name of the PDP counsel.
Note:
The matter of the names of the PDP and Atiku/Obi counsel, Dr. Uzochukwu is different.
While Dr. Uzochukwu sufficiently satisfied the lower court that Livinus and Livy are the same, President Buhari made no pleadings or submitted no evidence or affidavit to prove that Muhammadu Buhari and Mohamed Buhari are the same.
In concluding, Chief Olanipekun asked the Supreme Court to dismiss the appeals of the PDP and Atiku/Obi, describing the PDP and it’s Presidential Candidate as bad customers.
For the APC, Chief Fagbemi adopted his written replies and submissions and asked the court to dismiss the PDP and Atiku/Obi’s appeals.
