BREAKING: Nnamdi Kanu’s Trial Adjourned Till October As DSS Fails To Produce IPOB Leader In Court

The Department of State Services, DSS, failed to appear before the Federal High Court in Abuja on Monday to continue the trial of Nnamdi Kanu, the jailed leader of the Indigenous People of Biafra, IPOB.

M. B. Abubakar, a government lawyer, blamed Kanu’s absence in court on “logistical challenges” when the matter was called up around 11:09 a.m.

While conceding that the case had been scheduled for hearing, Abubakar told the court that he was prepared to proceed in Kanu’s absence and that he had three witnesses ready to testify.

The prosecution, on the other hand, asked the court for guidance on whether the case may be continued now that the High Court has begun its annual vacation.

He claimed that without a Fiat from the Chief Judge of the High Court, it would be impossible to proceed with the case.

Kanu’s lawyer, Mr. Ifeanyi Ejiofor, testified in court that his client’s life was in danger.

For the past 10 days, Ejiofor has been unable to see his client, he told the court.

“My lord, speaking from the Bar, I got it on good authority that my client has been taken away, outside the jurisdiction of this court”, Ejiofor added.

He further argued that it would be in the best interests of justice if the court’s Chief Justice issued a Fiat allowing the trial to continue throughout the holidays.

Meanwhile, trial Justice Binta Nyako stated that the case could not proceed without the Defendant present.

“I am also worried why the Defendant is not here. The first step in a criminals matter is to provide the Defendant in court. He is not here.

Though Justice Nyako acknowledged that she could not proceed with the case without Fiat allowing her to sit as a vacation judge, she made an order, directing the DSS to grant Kanu access to his lawyers.

The judge also ordered that Kanu must be produced before the court on October 21 which is the next adjourned date for the matter.
