Breaking: Court vacates order restraining APC from National Convention

March 18, (THEWILL) – An FCT High Court in Kubwa, has vacated an order of interim injunction restraining the ruling All Progressives Congress (APC), from conducting its National Convention scheduled for March 26, 2022.

In his judgment on Friday, Bello Kawu, the judge, said the Plaintiff lacked the locus to sustain the restraining order.

Salisu Umoru (the plaintiff in the matter), had dragged the APC, the Chairman Caretaker Extraordinary Convention Planning Committee and Gov. Mai Mala Buni and the Independent National Electoral Commission (INEC,) before the court to challenge the planned convention.

Umoru in his reliefs sought an order directing the APC and its Chairman caretaker/Extraordinary convention Planning Committee, Buni to stop its planned National Convention.

He also sought an order directing Buni to begin reconciliation process to resolve all the disputes that emanated from the local government congresses before the conduct of APC National Convention.

The court had on the strength of an application that was filed by Plaintiff, granted an interim injunction restraining the APC from proceeding with the scheduled National Convention.

But dissatisfied with the order, the APC approached the court with an application to set it aside.

While granting APC’s application on Friday, Justice Kawu, held that the  Plaintiff lacked the locus to sustain the restraining order.

The court held that the order of injunction is issued against the APC on November 18, 2021, has been overtaken by a recent judgment the Supreme Court delivered on a similar matter.

Justice Kawu, however, adjourned Plaintiff’s substantive suit till March 30 for hearing.
