A 38-year-old Nigerian woman has lost her High Court action to prevent the deportation of herself and her two children, one of whom has ADHD and has recently been diagnosed with autism.

Olivia Agbonlahor, who has been residing in Clonakilty, Co Cork, had claimed her six-year-old son Great would be outcast because of his condition if he was forced to return to Nigeria.

Lawyers for Olivia and her six-year-old twins Melissa and Great had claimed that their deportation would be a violation of their rights under Article 8 of the European Convention of Human Rights.

Today, Mr Justice Kevin Feeney rejected the action, saying the applicants had not established that there were exceptional circumstances in this case.

Olivia spoke of her disappointment afterwards and her lawyers indicated that they may take the case to the Supreme Court.
