Detained leader of the Niger-Delta People's Volunteer Force NDPVF, Alhaji Mujahid Asari-Dokubo, has filed a suit against the State Security Services (SSS) and its director-general, Colonel Kayode Are, over his re- arrest from the custody of the police and subsequent detention by the security outfit.

In an ex-parte application by his counsel, Mr. Festus Keyamo, Dokubo, who is seeking the leave of the court for the enforcement of his fundamental human rights, described re-arrest by the SSS from the custody of the police where he was kept by order of court, for a fresh offence yet to be disclosed, as unconstitutional, illegal, null and void.
Men of the SSS had, on Wednesday, August 30, 2006, taken the NDPVF leader into custody on a yet to be disclosed offence.
But in his application, Dokubo told the court that the action of the SSS violates his fundamental rights as guaranteed under section 34, 35 and 36 of the 1999 constitution.
He is accordingly asking the court for a mandatory order compelling the respondents to charge him to a competent court of law, if any offence has been established against him.
The embattled NDPVF leader is also praying the court for an order restraining the respondents from further detaining him without a formal charge.
In addition, he is asking for an interim order compelling the respondents to produce him before the court on the next adjourned date to ascertain his state of health as well as an order allowing him to have access to his lawyers, doctors, friends and family members.
Dokubo was arrested on September 19, 2005 by the Rivers State Commissioner of Police after which he was flown to Abuja where he was charged with treason. His efforts to get bail have not yielded fruits.
No date has been fixed by the court on his application.
