79 Year Old Man Sues Edo Police


A 79-year old Benin Prince, Michael Isede has filed a law suit at the Benin High Court, seeking an order of injunction, restraining men of the Edo State Police Command from incessantly arresting and detaining him over a crime which a Benin Magistrate court had, in November 2004, discharged and acquitted him of.

BENIN CITY - A 79-year old Benin Prince, Michael Isede has filed a law suit at the Benin High Court, seeking an order of injunction, restraining men of the Edo State Police Command from incessantly arresting and detaining him over a crime which a Benin Magistrate court had, in November 2004, discharged and acquitted him of.

The plaintiff also asked the court to order the state police command to pay him the sum of one million naira as compensation for damages and torture metted on him by members of the command on several occasions.

Defendants in the law suit are the Commissioner of Police Edo State; Inspector Jimoh Fatai of the Police Area Command, Mr Sajoh, Benin Area Command; Police Constable David Felix and Police Cpl Simeon Osai of the Benin Area Command.

In the suit filed by the plaintiff's counsel, L.A. Ehonuaye Esq, with number FHC/B/CS/1/05, dated January 6, 2005, the plaintiff pointed out that "I have been arrested and detained by the defendants on various dates including 16th, 17th, 25th, 26th, 27th and 28th November, 2004 on malicious and frivolous reports at the instance of the police Benin Area Commander, Mr Sajoh and police constable, David Felix, for no just cause nor court order.

"That I had been arrested by the respondents and detained for unlawful assault by the 4th Respondent, and of allegedly stealing Constable David Felix's GSM mobile phone valued at twelve thousand naira, with MTN line valued at two thousand five hundred naira, on the 16th day of November, 2004 at the applicant's house.

"These malicious and frivolous charges were dismissed by the Benin Senior Magistrate Court 2, November last year. That I was not granted bail during arrest and detention by the Respondents while I was kept in their so-called criminal cell and no member of my family or legal practioner was allowed access to me. I was served very small food once in two days interval."
