Man gets 5 years, 40 strokes for attempted rape


An Upper Sharia Court in Bauchi state has sentenced a 25-year old man, Mallam Hassan Ado to five years imprisonment for attempting to rape a seven year old girl who was indentified as Amina Umar.

An Upper Sharia Court in Bauchi state has sentenced a 25-year old man, Mallam Hassan Ado to five years imprisonment for attempting to rape a seven year old girl who was indentified as Amina Umar.

The sentence of Ado is coming just after a Sharia Court of Appeal in the state, ordered the retrial of Mallam Rabiu Abdullahi, a 33-year old man who was convicted and sentenced to amputation of right arm by a Ningi Upper Sharia Court early last year.

Mallam Ado, according to the court, had invited the girl and was attempting to have canal knowledge of her, when a policeman on surveillance was attracted to the scene by Amina's cry.

On approaching the scene, Daily Sun learnt the policeman was said to have caught Mallam Ado attempting to defile the girl, and consequently arrested him.
The accused was charged with attempted rape, which is contrary to section 232 of the Sharia Penal Code, Bauchi 2001.

Ado pleaded guilty to the charge, prompting the Judge, Alkali Musa Barde to sentence him to five years imprisonment and 40 strokes of the cane, which was immediately administered on him.
Alkali Barde said he could not give the convict an option of fine because, "the sentence would serve as a deterrence to others," but gave him an option to appeal the judgement in thirty days.
Similarly, the Upper Shaira Court has commenced hearing in an ordered retrial case of amputation of one Rabiu Abdullahi for causing grievous injury to one Umar Usman, his cousin at Dogon Ruwa village in Ningi local government area.

Abdullahi, in the appeal, was said to have amputated the right arm of Usman, after the latter caught the former stealing his corn in the farm and reported the matter to the police.
Abdullahi, was said to have been dissatisfied with his brother's detention at the police station and vowed to deal with him, a threat he made true and was said to have cut off the right arm of Usman at the market square.

He was subsequently arrested and taken to the Ningi Upper Sharia Court, where he was sentenced to amputation of his right arm.
But Abdullahi, while expressing dissatisfaction with the judgement, appealed, claiming that he was not given a fair hearing at the Upper Shari'a Court and also cl;aimed that he committed the offence under the influence of Indian hemp.
