Justice Thomas Istifanus of the Court of Appeal, Ibadan, Oyo State, this morning, dismissed the appeal filed by the ANPP and the DPA against the ruling of the Oyo state Election Petitions Tribunal, which declared Otunba Adebayo Alao-Akala winner of the 14 April, 2007 governorship election.
Justice Thomas Istifanus of the Court of Appeal, Ibadan, Oyo State, this morning, dismissed the appeal filed by the ANPP and the DPA against the ruling of the Oyo state Election Petitions Tribunal, which declared Otunba Adebayo Alao-Akala winner of the 14 April, 2007 governorship election.
Justice Istifanus dismissed the appeal for lack of diligent prosecution, stressing that counsel to the appellants failed to transmit the necessary records needed by the court for adjudication. The judge stated further that grounds of appeal were not made known to the court. 'I hereby dismiss the petition for want of grounds of prosecution,' Justice Itisifanus ruled, while dismissing the appeals.
