Court of Appeal, Lagos division, on Monday dismissed the appeal filed by the Peoples Democratic Party (PDP) governorship candidate in the April 2007 polls in Lagos State, Musiliu Obanikoro challenging the decision of the election petition tribunal.
The state election petition tribunal had late last year dismissed Obanikoro's suit contesting the victory of Governor Raji Fashola of Lagos State during the last governorship election.
Dismissing the action, the appellate court held that Obanikoro had not shown any interest to prosecute the appeal which had been filed since last year.
Obanikoro had earlier filed a petition before the tribunal praying it to nullify the declaration made by the Independent National Electoral Commission (INEC), announcing Fashola as the elected governor of the state, alleging malpractices.
A similar application filed by Mr Jimi Agbaje of the Democratic Peoples Alliance (DPA), had also been dismissed by the tribunal.
